The meeting was held in the Historic Watts de Peyster Village Hall. It began at 7:00 PM.
Minutes from June 12, 2023 were reviewed.
Pamela Morin made a motion to approve the minutes from June 12, 2023. JP Ward seconded. All in favor. The minutes were approved.
Tivoli General Fence – Site Plan Review
Andrea Shilling and Cameron Price, the owners of Tivoli General, were present to present the application. They propose to add a removable fence to surround outdoor/sidewalk seating in front of Tivoli General to allow their customers to have alcoholic beverages while seated outdoors. The Liquor Authority requires such a barrier. The proposed fence would be fabricated.
Pamela Morin asked about the dimensional requirements for the fence. The applicants have been unable to speak to anyone at the Liquor Authority to get that information. Mike Billeci said that the Planning Board will need to know the height of the fence.
Pamela Morin asked about whether the fence would be removed at night. Yes, the fence will be attached to the wall with a pin and there will be a hinge at the front corner allowing it to fold; the fence could be folded back against the building at night or removed entirely. The applicants’ preference would be to take it in at night with the tables and chairs. Lisa Schwarzbaum asked about when the fence would be put out; anytime the store is open, but likely not in the winter when outdoor seating is not desired.
There was a discussion about how the ends of the fence would be secured so that they will not swing freely. That is to be determined. Perhaps a sandbag or a pin into a sleeve in the sidewalk will secure the ends.
The spatial dimensions were discussed. 4 feet of clear sidewalk is required from the curb to the fence.
Lighting was discussed. The lighting from inside the storefront is sufficient lighting and there will be candlelight.
Pamela Morin asked about the total seating. There are 14 seats inside. The BIZEO determined occupancy. She questioned whether the applicants had received approval for the outdoor seating previously. Mike Billeci confirmed yes.
Mike Billeci stated that the Planning Board needs to see the exact design of the fence.
Lisa Schwarzbaum discussed SEQR and stated that it is a Type II action. She read a resolution declaring the action to be Type II. Mike Billeci made a motion to approve the resolution; Pamela Morin seconded. All in favor.
Lisa Schwarzbaum requested that the application be sent to the county for review because the property is on a county road.
Parking was discussed.
A public hearing was considered and the Planning Board determined none was needed.
The applicants will return to the next meeting with a drawing of the exact dimensions of the fence and its connections/attachment and with the Liquor Authority requirements.
Old Business – Plane Hall
Pamela Morin made a motion to re-schedule the public hearing from June 26th to August 14, 2023 at 7 pm. Mike Billeci seconded. All in favor. The public hearing was scheduled for Monday, August 14, 2023 at 7pm.
Lisa Schwarzbaum announced that Mike Billeci has resigned from the board and that this would be his last meeting.
Mike Billeci made a motion to close the meeting. Pamela Morin seconded. All in favor. The meeting was adjourned at 7:23.
