The meeting was held in the Historic Watts de Peyster Village Hall. It began at 7:03 PM. Lisa Schwarzbaum stated that Bill Shilling had resigned from the board to become a Village Trustee and JP Ward had been sworn in as a full member of the board.

 

Minutes

Minutes from December 12, 2022 were reviewed.

Mike Billeci made a motion to approve the minutes from December 12, 2022. Donna Matthews seconded. All in favor. The minutes were approved.

Old Business

58 North Rd – Special Permit & Site Plan Review

Lisa Schwarzbaum read the public notice for the public hearing for 58 North Rd. and Pamela Morin made a motion to open the public hearing. JP Ward seconded. All in favor; the public hearing was opened.

Lisa Schwarzbaum asked the applicant to introduce the project. Gail Armstong stated that she was applying for a special permit to bring her two personal horses to live with her at 58 North Rd. It is the property that her parents owned since 1969 and had previously had horses on. She plans to restore the existing barn and fencelines as they were previously.

Members of the public were instructed to direct comments to the board.

Phyllis Palmer stated that when she moved to Tivoli 32 years ago, one of the best parts was the horses that were within eyesight. The horses were a beautiful thing to see and hear compared to the overgrown pastures as they are now.

Leigh Palmer stated that he seconds those comments as the closest neighbor to the property in question.

Trish Tieger commented about the positive experience of feeling like she was living in the country with the Armstrongs’ horses and the Levines’ horses years ago.

Lisa Schwarzbaum discussed SEQR. Referring to the list of Type II actions, she found that the action fit under #2, #12 and #18 on the list, but #12, accessory structures including barns, etc for allowed residential uses fit best.

Mike Billeci made a motion to declare the action Type II. Pamela Morin seconded. All in favor. The action was declared to be Type II.

Lisa Schwarzbaum addressed Mike Billeci’s concern from the previous meeting regarding code violations for the property. She contacted the building inspector and confirmed that there are no current violations for 58 North Rd. Mike Billeci responded that if the ZEO says it is all good, it is all good.

Donna Matthews made a motion to close the public hearing. Pamela Morin seconded. All in favor. The public hearing was closed.

Lisa Schwarzbaum stated that everything had existed previously, the use and the buildings. She did not see a reason not to grant the special permit. The board agreed.

Donna Matthews made a motion to grant the Special Permit. Pamela Morin seconded. All in favor. The Special Permit was granted.

The board next discussed Site Plan Review which is required after the Special Permit is approved. Lisa Schwarzbaum asked if there is anything that needs to be added to the site plan that was submitted by the applicant other than the signing block. Mike Billeci stated that he thought that the nature of the fencing should be added to the site plan.

Gail Armstrong answered that the front line of the fence would be three horizontal boards and stock wire along the road. The back sides of the paddocks will have three strands of 2 inch electric tape.

Lisa Schwarzbaum stated that adding the details about the fencing and the signing block can be conditions of approval.

Pamela Morin confirmed that it is a single parcel. Yes. 6.5 acres? Yes.

Donna Matthews made a motion to grant site plan approval. Pamela Morin seconded. All in favor. The Site Plan was approved.

LWRP Consistency Review for the Village of Tivoli Sewer Plant

Lisa Schwarzbaum stated that the Planning Board had been asked to complete a LWRP consistency review for the new sewer plant. The Planning Board had completed the review in 2021, but a few details have changed relating to location, so the review is being repeated. The board looked through the consistency review form that finds that most issues are N/A and the relevant issues are found to have no impact. The project is a replacement of the existing sewer plant.

Mike Billeci stated that he found nothing to be inconsistent and made a motion to find the project consistent with the LWRP. Pamela Morin seconded. All in favor. The project was found to be consistent with the LWRP.

Lisa Schwarzbaum asked if there were any more questions or other items to discuss. No.

Donna Matthews made a motion to close the meeting. Pamela Morin seconded. All in favor. The meeting was adjourned at 7:19.
