NOTICE OF ADOPTION OF BOND RESOLUTION

SUBJECT TO PERMISSIVE REFERENDUM

 

NOTICE IS HEREBY GIVEN that at a meeting held on the 10th day of March, 2021, the Village Board of the Village of Tivoli, Dutchess County, New York, duly adopted a supplemental bond resolution, an abstract of which follows, which resolution is subject to a permissive referendum pursuant to Section 36 of the Local Finance Law and Article 9 of the Village Law of the State of New York.

 

The Village previously adopted a bond resolution dated July 25, 2018 authorizing the reconstruction and construction of improvements to the Village’s wastewater system including improvements to the existing wastewater treatment plant, pump station, and sewage collection system, and related improvements, and authorizing the issuance of serial bonds of the Village of Tivoli, Dutchess County, New York.  The supplemental bond resolution amends and supplements the bond resolution adopted July 25, 2018 to modify the project scope to include replacement of the existing wastewater treatment plant at the Montgomery Street DPW site, to authorize an increase of $3,267,700 in the maximum estimated cost, for a total maximum estimated cost of $7,011,900, and to authorize a modification to the plan of financing to authorize the issuance of an increased aggregate principal amount not to exceed $7,011,900 pursuant to the Local Finance Law to finance the cost thereof, with the proceeds of a WIIA grant in the estimated amount of $919,150 to be used to pay a portion of the cost of such purpose.

 

Said supplemental bond resolution shall take effect thirty days after adoption, unless there shall be filed with the Village Clerk a petition signed and acknowledged by the electors of the Village in number equal to at least twenty percentum of such electors in the Village, as shown on the register of elections for the previous general village election, protesting against this resolution and requesting that the matter be submitted to the electors of the Village for their approval or disapproval in the manner provided by Village Law.

 

The project has been determined to be a Type I action which was determined not to have a negative effect on the environment in accordance with the State Environmental Quality Review Act.

 

A copy of the resolution is available for public inspection during normal business hours at the Office of the Village Clerk, located at the Village Hall, Historic Watts dePeyster Hall, 86 Broadway, Tivoli, New York.
